When am I entitled to compensation for a delay, cancellation, denied boarding, downgrade or missed connection?
You are entitled to reimbursement if you fly within EU member states with a company established in a member state. However, if you are flying with a company that does not* belong to the EU member states, the rule applies that your flight must have been depart from* a member state.
*Example: if you fly with Emirates from Dubai to Amsterdam, this flight is not covered. It is however, if you fly the opposite way with Emirates, from Amsterdam to Dubai.
To get compensation in the event of a delay, the delay must have been calculated for at least 3 hours from the scheduled arrival time.
Does the regulation for reimbursements only apply to flights from EU member states?
No, in addition to the EU member states (see overview elsewhere on this page), the regulations also apply to flights departing from Switzerland, Iceland and Norway.
What is the ammount of compensation in the event of a delay?
a. € 250.00 for all flights up to 1500 km with a delay of more than 3 hours (eg Amsterdam – Paris)
b. € 400.00 for all flights longer than 1500 km with a delay of more than 3 hours (eg Amsterdam – Malta)
– For flights from the EU with destination outside the EU, the compensation is:
a. € 250.00 for all flights up to 1500 km with a delay of more than 3 hours (eg Amsterdam – Geneva)
b. € 400.00 for all flights from 1500 km to 3500 km with a delay of more than 3 hours (eg Amsterdam – Antalya)
c. € 600.00 for a delayed flight of more than 3500 km with a delay of 4 hours or longer (e.g., Amsterdam – New York)
d. € 300.00 for a delayed flight of more than 3500 km with a delay of between three and four hours
How long will it take for the compensation to be paid?
This depends, among other things, on the type of claim and the airline. We know from experience that some companies take action or pay out faster than others. This can vary from a few days to a few months. We do our utmost to successfully settle your claim within the shortest possible time.
What are the costs of Fairclaim’s services?

Within what period do I have to submit my claim?
According to the law, claims can be made up to 2 years after the flight date. Exceptions are countries such as Germany, the United Kingdom, Portugal and Belgium. Here, the term can be shorter or longer. However, we recommend that you submit any claim as soon as possible. Don’t wait too long with this. We are of course willing at all times to do our best to process an “old” claim for you and to reclaim compensation from the airline.
